How to Order:
Welcome to the JA Tennis Pro Shop terms and conditions for use. We are delighted that you wish to use our website (“Site”). We have established a number of terms and conditions that, by using our Site, you agree to be legally bound by. They are therefore important and so please take the time to read them. If you do not agree with terms & conditions set out below please do not use the Site. We also recommend that you periodically check these terms and conditions, because we reserve the right to change them at any time and the terms and conditions that are available on our Site at the time you are using it will be those that apply during such use. In connection with our terms and conditions, where we refer to "Content" we mean all the text and images contained in or available from, our Site. All orders can be placed online through the Website subject to maintenance. All orders subject to availability.
Availability:
We do not guarantee that our Site or Content will always be available, nor do we guarantee that we will provide an error free service. We may suspend our service for operational reasons such as repair, maintenance or improvements or otherwise in emergencies and we may change or discontinue the availability of any Content, goods or services at any time as we see fit.
Method of Payment:
You can pay either by PayPal, cheques, or cash (by arrangement).
Out-of-Stock:
If any item you have chosen is unavailable, we aim to contact you via your e-mail address or via phone within 5 working days.
Delivery:
Local collection can be arranged from one of several tennis clubs in the Surrey / Hampshire area. We will endeavour to despatch goods as promptly as possible (usually within 3-5 working days). The maximum period of delivery would be within 30 days, unless specifically agreed with you the customer. We undertake to inform you of any subsequent change to the delivery time.
Addresses within the UK mainland:
In most cases we utilise Royal Mail or Parcel Force for cost effective delivery. All shipping charges are calculated based on weight and delivery address. This charge is added to your order before you enter your payment details in the checkout area. Item availability and estimated delivery times are listed adjacent to the pictured products. Please note that extra charges may be applied to deliveries for orders outside of the UK mainland. If you are unsure please contact us to confirm, or alternatively if extra charges are to be applied we will contact you to discuss prior to processing the order. Please note that the couriers and delivery services we use tend to deliver during the working day. You may find it easier to give a work address if it is unlikely that anyone will be in to sign for your order. For heavy or bulky items we reserve the right to charge a redelivery fee if the customer is not there to collect the goods as arranged.
Signing for Goods:
Upon delivery of goods please check them carefully for signs of possible damage before you sign to say that you have received them in good condition. It is not always possible to determine if the internal contents have been damaged and we strongly advise you to cross out the word ‘Received in good condition’ and write ‘Damaged’ before you sign, or to write ‘Damaged’ above your signature. This is to ensure that if necessary, a claim can be made against the courier company. Unfortunately our carriers accept no other wording and it is extremely difficult for us to claim that your goods were damaged in transit if you have previously signed to declare that you received your order in good condition. If you receive a parcel, which is obviously damaged beyond all levels of acceptability, please REFUSE delivery. Do not sign for the items, and then contact customer care immediately. We will resolve the problem in the best and quickest means possible. Fortunately this happens very rarely.
10 Day Money Back Guarantee:
Sometimes it may be difficult to purchase a product over the internet, especially when you can only see a picture and description of a product. To add that extra bit of comfort we offer the Flaming Tennis ten day money back guarantee. It’s simple. If you don't like the goods or they are not deemed suitable for your need the goods can be returned to us for a full 'no questions' refund (minus any delivery charges). The ten days start from the day the goods are received. The only stipulation is that we receive the request for a refund in writing preferably as an email, that we receive the goods back in the condition they arrived with you (as new), and that they are repacked into the box/packaging they arrived in. If returned goods are not repacked properly by the customer they may incur a 10% repacking/restocking charge. In general few returns are charged this, however if return goods are in such a condition that costs are incurred to recheck the product then the 10% may apply .We will pay all the carriage charges for the delivery and the return of faulty products to our warehouse when collections are made from UK mainland ( England, Scotland, Wales ). Refunds will be credited back within 30 days of the cancellation. Please note our carriers only uplift Monday to Friday. Where the consumer has exercised the right to cancel, money will be returned within 30 days of cancellation. If the goods are faulty and are rejected within 7 working days from receipt of goods to rejection of goods, a full refund plus postage costs can be claimed.
Returning Items by Mail:
1. Fill out the back of your packing slip as follows:
• State the item(s) that you are returning.
• To assist processing please state the reason for the return.
• Indicate whether you would prefer a refund to the credit card originally used, a cheque, or an exchange*
• State the preferred delivery address for your exchange or cheque refund.
• If you are asking for a refund of the delivery expense please include a receipt for this cost.
2. Package the return securely (in the original package if possible), and include the packing slip and reason for return along with the original unique order ID. Packages must be returned pre-paid, and for your protection, we recommend that you use a recorded delivery service. If your item is faulty and you have requested for the delivery charge to be refunded, please note it can only be processed if the original receipt for this cost is included.
3. Send the package to Returns Department.
If you have lost your packing note please contact us.
Complaints:
We aim to deal with all complaints as effectively as possible. In the first instance, your complaint may be emailed to us, or mailed to the Customer Service Department. We aim to acknowledge by email any complaint made within 5 days, and to conclude our investigations as soon as possible thereafter. Telephone complaints will not necessarily be acknowledged by email prior to investigation. A likely timescale for resolution will be provided upon request, but this timescale will be dependent upon the specific nature of the complaint.
Data Protection and Privacy:
Any details which you provide to us from which we can identify you are held and processed lawfully and in accordance with the Data Protection Act 1998. Use of Information:
JA Tennis Pro Shop is the sole owner of the information collected on this Website. We will not disclose or divulge this information to others in ways different from what is stated in these terms and conditions. JA Tennis collects information from users of our website at several different points.
1. Where an order form exists, we will request information from the user as required. Here a user must provide contact information (like name, shipping address, landline telephone number) and financial information (like credit card number, expiration date). This information is used for billing purposes and to fulfil customers' orders. In case of difficulty in processing an order, this information will be used to contact the user.
2. We may use an outside shipping company to ship orders, and a credit card processing company to bill users for goods and services. These companies do not retain, share, store or divulge any personal information for any secondary purposes.
3. We may use technology to track the patterns of behaviour of visitors to our site. This can include using a "cookie" which would be stored on your browser. Subscription by any user to our Email Newsletter requires an email address. If a user's personal information changes (such as your address), or if a user no longer desires our service, we provide a way to correct, update or remove that user's personal data provided to us. The design of our Site including its text, graphics, icons, content, structure, selection and arrangement are wholly owned by JA Tennis Pro Shop and all of our rights are reserved. In addition, our Site contains a significant amount of Content, the copyright, trade marks and other rights to some of which are owned by their respective owners, who reserve all of their rights in respect thereof. You must not and must not permit anyone else to either copy, download, store, modify, adapt, transmit, distribute, perform, play or show in public, broadcast, publish or otherwise use any part of the Content on our Site without our prior written agreement or that of the relevant owner of the Content in question. Price and availability information is subject to change without notice.
Notification of Changes:
Any changes to our privacy policy will be placed on our website. If we decide to use personal information in a way different from that stated at the time it was collected, we will notify users by way of an email. Nothing in these terms and conditions of use shall exclude our liability for death or personal injury resulting from our negligence or any other liability that we are prohibited from excluding by law. Although we shall take reasonable steps to prevent the introduction of viruses, we do not warrant that any information or other content accessible via our Site is free of viruses, Trojan horses or other harmful matter, nor that our site will be error free.
